Case n. 5 (The possibility of institutionalizing the grandmother to a care home for the elderly)



A woman with her son came without a notice to come to the Regional Department of Employment Office in Jihlava, the Department of Non-insurance Benefits, and told you the following information.

The lady is 86 years old. She became a widow 7 years ago. She lives alone in a house 3 + 1. Her family members visit her regularly twice a week. She spends a weekend with her son once a month and with her daughter once a month as well.

The lady was granted a benefit for care of the third degree of dependence in March 2011. Services are delivered by care servicelunch is delivered to her every day, her household is cleaned twice a week, and she is brought to the centre of personal hygiene three times a week.

The lady must regularly attend professional medical advice. Her son is interested in the possibility of greater security of his mother.

The lady is a permanent resident at Jihlava, Rantířovská 27, her son at Batelov, Luční 369.

Task:

Solution:

The lady has a chance to show interest in being provided emergency care. The choice of provider is not bound to the place of residence or the number of applications for admission. A suitable provider of social prevention services can be found e.g. in the register of social services, which is publicly available on the Internet. The family should focus on contacting LIFE 90 Jihlava, which provides emergency services via the AREÍON (NB sensor, which monitors the movement of people around the apartment and it is 24 hours a day connected to the central control room).

After expressions of interest for the provision of emergency care, it is needed to substantiate the current medical findings and (at the discretion of the applicant) the amount of income. The emergency care provider will then perform a social survey by the woman. In case of spare capacity, they may begin to negotiate the conditions for the provision of emergency care.

The contract includes a determination of the participants concluding it – the service provider and the user, the type of services to be provided, to what extent and where, the amount of payment for services, when the contract enters into force, the conditions under which the participants may withdraw from the agreement, if the agreement is concluded for a definite or indefinite period, and the number of copies. In conclusion, there is stated when and where it was concluded and the signatures of the participants.

The woman may ask for a contribution on acquisition of a special aid – AREÍON at the Regional Department of Employment Office in Jihlava (on a prescribed form issued by the Ministry of Labour and Social Affairs). A written request is needed to be substantiated by the identity card, the amount of income for the previous year-quarter, confirmation that the aid is not paid by the health insurance or not available for rent.

The Employment Office performs a social survey by the applicant. It also asks the District of Social Security Administration for the assessment of the health condition of the woman. The medical assessor will require current medical findings from her general practitioner (note – he/she adds the conclusions of examinations of specialised doctors) and processes the report.

After that, the Regional Department of Employment Office decides in re. If the entitlement to a benefit for the special aids occurs, there must be decided on the amount of the benefits. In case, the claim does not arise, the application is rejected. (management of social assistance benefit for the disabled – benefit for the special aid)

The applicants must receive the decision into their own hands. Within 15 days of the receipt, they may file an appeal by the Employment Office, which ruled in the first instance. The appeal is decided in the second instance the Ministry of Labour and Social Affairs. (benefits in material need – appeal)

Benefit for the acquisition of a special aid is a repeated, social allowance.

A father of a minor child came without a notice to appear to the Municipal Authority of Jihlava, the Department of Social Affairs, the Department of Social and Legal Protection of Children to ask you for help in solving a situation, which he got in.

According to his announcement, he is divorced. According to the judgment of the District Court in Jihlava, his minor son was entrusted to mother’s care. He is determined to contribute to the maintenance of the son with the amount of 1,500 Czech crowns per month, which he properly pays. After the divorce, the mother and father agreed on the extent of father’s contact with the minor son, which was regular and without any difficulties.

The mother of a minor child has recently found ​​a new boyfriend and is thinking of marrying him and they started to hinder the father in regular visits of the son.

The mother with a minor child is registered for permanent residence (and lives) at Polná, Palackého 561, father at Telč, K Valše 78.

Task:
Focus on the implementation of the contact (= visits) between the father and his minor son.

Solution:

The Department of Social and Legal Protection of Children first carries out a social survey by the minor child’s mother and the interview with the boy. The mother will be advised that she is obliged to enable visits between the father and the son and to prepare the son properly and on time as well.

If the visits continued not to be realized, the father should file a proposal to regulate rights and duties in respect of a minor child at the District Court (according to the place of residence of the child) in Jihlava. The proposal shall be submitted in quadruplicate. One is intended to the guardianship file of the minor child and other to the participants of proceedings – mother, father and a minor child represented by a guardian automatically appointed by law by the court – usually  Municipal Authority of Jihlava – the Department of Social and Legal Protection of Children. (initiate guardianship proceedings)

Within the burden of proceedings, the court shall mainly hear the child’s parents, carries out an  interview with the boy (in the absence of parents), asks the guardian for a report on treatment conditions on the side of the both parents, and followingly requires  a report from school the boy attends and by a paediatrician. After the burden of proceedings, the court gives its judgment, which adjusts the extent of visits between the father and the son. (course management)

In case, even the judgment came into force, the visits with the son were not realized, the father could file a proposal for the enforcement of a decision to the court, on which basis the court may fine the mother, or initiate proceedings to modify the custody of the child.

A Club Hanoi is non-governmental non-profit organization uniting those who are interested in Vietnam – its culture, history and traditions – or in the life of Vietnamese community in the Czech Republic.

B Club Hanoi was founded as an informal organization by a group of former students of the Vietnamese studies at the Charles University in Prague. The organization was formally registered with the Czech Ministry of Interior on January 16th 2004. Since then the organization has been comprised of students and professionals in the field Vietnamese studies, as well as members of Vietnamese community or individuals interested in Vietnamese community in the Czech Republic or Europe joined the organization.

C Its mission is to promote Vietnamese culture and integration of Vietnamese community in the Czech Republic while emphasizing the preservation of cultural identity.

D The interaction between the Vietnamese minority and Czech majority is often complicated by the many differences between the Czech and Vietnamese cultures. The aim is therefore to take these differences and highlight their positive aspects and value for the society in the Czech Republic. In doing so, they want to affect the perception of the role and place of Vietnamese community in the Czech Republic. This community is often described as self-sufficient, hardworking and inconspicuous. However, its full cultural potential has yet to be recognized – Vietnamese traditions, literature, complex history or natural heritage remains to the majority of the Czech society unknown.

E Besides, raising awareness about Vietnam and Vietnamese culture, they also try to promote and support the principle of equal opportunities for Vietnamese living in the Czech Republic. The club seeks to increase participation of the Vietnamese community in the public life in the Czech Republic; it supports the independence of individuals in their own community and active participation on solving social issues of common interest.

F The members of the club believe that they can contribute in eliminating discrimination against Vietnamese community including the often mutual prejudices, communication and cultural barriers in the Czech Republic. This will be achieved by increasing access to information and by organizing common social and cultural Vietnamese-Czech events. Their goal is to positively affect change of attitudes and behaviour of particular groups in the Czech society – Vietnamese community, the general and professional public – in order to achieve a more open and stronger civil society.

A Leaders of the Commission on Security and Cooperation in Europe (U.S. Helsinki Commission) today expressed their support for the stiff sentences handed down in the Czech Republic to four neo-Nazis who firebombed a Romani family’s home in 2009.

B The court found David Vaculík, Ivo Müller, Jaromír Lukeš, and Václav Cojocaru guilty of complicity in attempted murder and property damage in an attack that left an infant with second and third degree burns over 80 percent of her body and injured three others. The four men were all sentenced to at least 20 years in prison. The sentences are reportedly the toughest ever handed down for a racially motivated crime in the Czech Republic. The rehabilitation ordeal of Natálka Siváková, who will be maimed for life, has gripped the Czech nation.

C “We welcome the verdict in this case as a small measure of justice for a Romani family that was clearly targeted for no reason other than their ethnicity,” said U.S. Senator Benjamin L. Cardin. “Nothing can compensate for the baby's injuries and suffering, but hopefully this sentence will not only put off future hate crimes, but send a signal to extremist elements in the Czech Republic that their day of reckoning is at hand.”

D The four men committed the crimes to celebrate Adolf Hitler’s 120th birthday. In court one defendant, Lukeš, wore the shirt of a White Power band. In the past three years, the Czech Republic has witnessed an escalation of attacks on Roma, and other manifestations of extremism.

E “I am heartened to hear Czech political leaders supporting justice in this notorious hate crime,” said Co-Chairman Congressman Alcee L. Hastings. “We call on the new Czech Government to address Romani human rights comprehensively, including by strengthening public understanding of Romani experiences during the Holocaust. I will also be greatly interested in the outcome of the ongoing trial of eight alleged perpetrators of the mob attack on Roma in Havirov.”

F In Havířov, a group of men attacked several Roma on November 8, 2008. One teenager was beaten into a coma and suffers permanent disability.

Amnesty says Czech schools still fail Roma Gypsies


A Czech schools are still riddled with "systematic discrimination" that ensures Roma children get an inferior education, Amnesty International says. The human rights group has called on the Czech Republic to end what it calls racial segregation in schools. It says Roma (Gypsy) children are often sent to schools for children with mental disabilities.

B In 2007 the European Court of Human Rights said this violated the right of Roma children to a full education. Amnesty says although the Czech government in 2005 changed the name of these "special schools" to "practical elementary schools", "the system which places children in these schools and teaches a limited curriculum essentially remains the same". In some places, it says, Roma children make up more than 80 % of the students of practical elementary schools.

C Roma children who stay in mainstream schools tend to end up in classes full of other Roma, as white parents will often move their children elsewhere, says the BBC's Rob Cameron in Prague. These Roma-only schools often provide a curriculum. All this, says Amnesty, reduces children's prospects of finding decent employment in the future, and reinforces their sense of social exclusion.

D Nicola Duckworth, Amnesty International's Europe and Central Asia programme director, said: "Education is the way out of an inhuman circle of poverty that affects a large part of the Roma population in the country. Unless the Czech authorities give them equal opportunities, they will be denying Romani children their chances for a better future and full participation in the life of the country."

E The BBC has yet to receive a response to the report from the Czech government. Previously, it has admitted to difficulties integrating the Roma community but has argued that since its schools were not set up specifically for Roma children, the system was not discriminatory.
